Frequently Asked Questions

What is bankruptcy?  Bankruptcy is a legal proceeding afforded to individuals (or businesses) who are unable to handle a financial crisis.  Bankruptcy is made available by federal law so that you can have a fresh chance.  The American dream can still be yours!

Will I lose my car or home?  Many clients are able to save a car or home. Legal strategies are available to assist clients in saving their family home or vehicle.  Call today to discuss all available legal options.  We can help!

Can I re-establish credit after a Chapter 7?   YES!!!After a Chapter 7 filing, you have no debt.  Thus, you are a creditor's  dream.  However, we advise our clients to be prudent in choosing any credit after filing for Chapter 7 bankruptcy.  Our clients are advised to be aware of credit terms and interest rates.  Ask about interest rates and other credit terms.  Many credit choices may be instantly available.  However, interest rates will improve with time.

Which type of bankruptcy will I be filing?  Many individuals file for bankruptcy relief under Chapter 7 or Chapter 13 of the U.S. Code.  Which one you qualify for is a function of your household income and expenses, debts, prior bankruptcy filings, and varoius other factors.  Below is a brief summary of both types:

Chapter 7:  This type of bankruptcy was enacted by Congress to allow individuals who are hopelessly burdened by debt to obtain a fresh chance by eliminating their unsecured debts (i.e. credit cards, utilitiy, and medical debt).   Chapter 7 is appropriate for debtors who are unable to pay a portion of their debts back to the creditors.  Chapter 7 is referred to as "liquidation" because debtors may have to surrender some of their assets in exchange for the elimination of their debts.   However, exemptions may be available to protect some or all of these assets.  Also, many debtors who have minimal equity and who are current on their payments are able to keep their home and vehicles during a Chapter 7 bankruptcy.  Call the experienced attorneys at Agnew & France today for your fresh chance!

Chapter 13:  This type of bankruptcy is an interest-free repayment plan that allows you to combine your debts and repay all or part of them while protecting you from creditor harassment. It is an excellent alternative for debtors whose financial problems cannot be helped by a Chapter 7 filing. Chapter 13 often provides much greater protection to debtors who own significant assets or have income that would not be exempt in a Chapter 7.   Chapter 13 may be appropriate for debtors who have a regular income but are unable to make their monthly creditor payments.  Also, debtors who qualify for Chapter 7, but are simply trying to protect a home or vehicle may find Chapter 13 more appealing.  Debtors who file for Chapter 13 bankruptcy protection typically pay off their obligations within 3-5 years, depending on the specific details of their case.  Since your debts will never be smaller than they are today, call Agnew & France to begin rebuilding your american dream!

What types of debts will NOT be discharged?  In a Chapter 7 bankruptcy case some of the following debts are non-dischargeable:  taxes, child support, alimony, recent cash advances, recent installment loans, student loans, criminal fines, traffic tickets, and some other debts.  Call us today to discuss your specific case!

Why should I hire a Toledo attorney?  There are a limited number of bankruptcy courts in Ohio.  The specific bankruptcy court which will handle your case is determined by where you live.  Debtors from various counties are required to attend all bankruptcy related hearings in Toledo, Ohio.   (See our home page for a full listing of counties which fall under the Toledo jurisdiction.) It is important that you choose an attorney who is familiar with local procedures.  The experienced attorneys of Agnew & France have filed hundreds of bankruptcy cases in the U.S. District Bankruptcy Court in Toledo, Ohio.  Let us handle your case.

Tell me about the credit counseling requirement.  Congress has mandated that all bankruptcy debtors successfully complete two credit counseling courses prior to the discharge of their bankruptcy case.  This requirement is intended to assist the debtor in maintaining financial success after a bankruptcy.  These courses are offered over the internet or telephone and most debtors will be required to pay a nominal fee.  In some cases, debtors may receive a fee waiver.  For a list of court approved credit counselors, contact Agnew & France today!

How much will bankruptcy cost?  Most debtors are surprised at the affordability of filing for bankruptcy.  The typical fees in most cases include attorney fees, court filing fees, and credit counseling fees.  When comparing large overall debts to typical bankruptcy fees, most debtors find a significant value in exchange for the eventual elimination of their debt and the immediate peace of mind.  Call today for your free consultation and initial fee quote.  The attorneys at Agnew & France offer large firm experience and small firm pricing!

Can I hire Agnew & France to represent me in creditor negotiations and avoid bankruptcy?  Yes, however this solution is advisable only in a small number of cases.  This scenario is appropriate for a debtor who has a small amount of debt and merely needs assistance is negotiating a short-term payment plan with their creditor.  Call us today and schedule your free consultation.  We will help you determine a course of action which fits your particular needs.  We will help you rebuild your American dream!
